Terms of service

The agreement between you and Avatique. Plain words first, details below.

1. Who we are

Avatique is owned and operated by ALPICAP Sàrl, 12 quai du Seujet, 1201 Geneva, Switzerland. Contact: [email protected].
These terms, the creator terms and the policies linked on the left form one agreement. If they conflict, these terms win, then the creator terms, then the policies.

You must be 18 or older, or the age of majority where you live if higher. We check age at sign-up and, where the law requires it, with an age-assurance provider.
Avatique hosts SFW and adult (18+) content. Adult pages are labelled 18+ and are only listed and viewable for signed-in adults.

Keep your login private and use two-factor authentication. You're responsible for activity on your account.
Creators may give their team access only through features we provide for that; creators remain responsible for everything sent from their account.

Creators set prices in US dollars. You see and pay them in your local currency (18 currencies) at the exchange rate shown when you check out. Where VAT or GST applies, it is included in the price shown; in the US and Canada, sales tax is added at checkout. Avatique processes payments and is the seller to fans for tax purposes where the law requires.
Subscriptions renew automatically until you turn auto-renew off. You keep access until the end of the period you paid for.
Some pages offer tiers above the standard subscription. When you upgrade, the unused part of your current paid period is credited against the first payment, the new plan starts that day and renews at its own price, and your previous renewal is cancelled. You can move to a lower plan once your current period ends.
If a creator raises their price, your current price stays the same for your existing subscription.
Credit in your wallet is a prepaid balance for use on Avatique. It is not money and can't be transferred. Unused purchased credit is refunded on request when you close your account.
Gifts, tips, tip-menu orders and paid messages are payments to the creator, made through Avatique. How creators are paid is set out in the creator terms.

Creators own their content. They give Avatique a licence to host, display, deliver and promote it on Avatique for as long as it is published, and for a short time after deletion to complete backups and legal holds.
Fans receive a personal, non-transferable licence to view content they have access to. Downloading, recording, sharing or re-uploading content is not allowed.
We never sell content and never use creators' or fans' content to train AI models without an explicit opt-in.

Everyone must follow the acceptable use policy. Breaking it can lead to removal of content, restrictions, suspension or closing your account.
Each decision comes with a statement of reasons and can be appealed. See complaints and appeals.

We give at least 30 days' notice of material changes by email and in the app. If you don't agree, you can close your account before they take effect; unused credit is refunded.

Nothing in these terms limits liability that cannot be limited by law, including your rights as a consumer.
Otherwise our liability is limited to the greater of the fees you paid us in the 12 months before the claim and USD 1,000.

Swiss law applies; the courts of Geneva, Switzerland, have jurisdiction. If you're a consumer in the EU or UK, you keep the protection of your home country's mandatory laws and may bring claims in your home courts.
